Terms of Service

1. Agreement

These Terms of Service govern your use of Lughara's website, learning dashboard, speaking-practice tools, tutoring features, classroom features, and related services collectively referred to as the "Services."

By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility and Accounts

You must be at least 13 years old to use Lughara. If you are under the age of majority where you live, you may use the Services only with permission from a parent or legal guardian.

You are responsible for providing accurate account information and keeping your login credentials secure. We use third-party providers, including Clerk, to manage authentication and sign-in.

If you use Lughara through a classroom, teacher, tutor, school, language center, or other managed program, that instructor or organization may manage your access and may receive limited learning progress information, such as assigned lessons, completion status, scores, weak words, and progress summaries.

3. What Lughara Provides

Lughara provides language-learning and speaking-practice tools, including guided lessons, AI-powered practice, pronunciation feedback, recall exercises, tutoring support, classroom features, and related educational software.

Features may change over time. We may add, remove, limit, or modify features as we improve the Services.

4. Beta and Experimental Features

Some parts of Lughara may be offered as beta, early-access, trial, or experimental features. These features may be incomplete, inaccurate, unstable, or unavailable at times.

We may change, limit, or discontinue beta features at any time.

5. Audio and AI Features

Some features require microphone access, voice input, audio processing, or audio uploads. By using those features, you allow Lughara and its service providers to process your audio, transcripts, prompts, responses, pronunciation attempts, and related data as needed to provide speaking practice, pronunciation feedback, transcription, text-to-speech, AI feedback, and related functionality.

AI-generated feedback, translations, explanations, transcripts, scores, and responses may be imperfect or inaccurate. You should use your own judgment. Lughara is not intended for legal, medical, financial, emergency, or other high-stakes decisions.

6. Your Content

You keep ownership of content you submit to Lughara, including text, audio, prompts, responses, lesson inputs, and other materials.

You give Lughara permission to host, store, process, analyze, display, and use your content only as needed to operate, provide, secure, troubleshoot, support, and improve the Services.

You must have permission to submit any content you provide. Do not submit another person's voice, personal information, or content without permission.

7. Acceptable Use

You agree not to misuse the Services. You may not:

• break the law;
• access accounts, systems, or data without permission;
• interfere with or disrupt the Services;
• scrape, copy, reverse engineer, or exploit the Services in unauthorized ways;
• use bots or automation to abuse the Services;
• submit harmful, abusive, unlawful, infringing, or inappropriate content;
• impersonate others;
• submit another person's voice or personal information without permission;
• use the Services to copy Lughara's curriculum, software, workflows, or product experience;
• abuse AI, audio, tutoring, or classroom features.

8. Reasonable Use

We may apply reasonable usage limits to protect service quality, prevent abuse, manage AI and infrastructure costs, and keep the Services available for other users.

We may throttle, restrict, suspend, or terminate access if usage is excessive, automated, abusive, fraudulent, harmful, or inconsistent with normal educational use.

9. Educational Purpose

Lughara is an educational service. Learning progress depends on many factors, including practice time, consistency, prior experience, teacher involvement, and personal learning differences.

We do not guarantee fluency, pronunciation scores, certifications, placements, academic results, professional outcomes, or any specific learning timeline.

10. Tutoring and Classes

Lughara may offer tutoring, group classes, trial sessions, or instructor-led programs.

Tutors, teachers, instructors, and language centers may be independent providers or third-party partners unless we state otherwise. We do not guarantee that any specific tutor, teacher, class, or time slot will always be available.

You agree to treat tutors, teachers, instructors, students, and other users respectfully. We may suspend or terminate access for harassment, abuse, threats, discrimination, inappropriate conduct, repeated no-shows, or behavior that disrupts a session or class.

Teachers may review limited progress information, such as completed lessons, assigned modules, practice status, weak words, scores, and progress summaries, to support instruction.

11. Payments

Lughara may currently be offered for free, as beta access, or as early access. We may introduce paid services later, including subscriptions, tutoring sessions, school plans, classroom access, or other paid products.

If paid services are introduced, pricing, billing, renewal, cancellation, trial, and refund terms will be provided during signup or purchase.

12. Third-Party Services

Lughara uses third-party providers for authentication, AI processing, speech processing, hosting, storage, analytics, email, security, scheduling, and other operations.

Your use of those services may also be subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

13. Service Availability

We try to keep Lughara available and working well, but we do not guarantee that the Services will always be available, uninterrupted, secure, accurate, or error-free.

We may change, suspend, limit, or discontinue any part of the Services at any time.

14. Intellectual Property

Lughara's software, design, branding, curriculum, lesson content, exercises, prompts, workflows, images, text, audio, and other materials belong to Lughara or its licensors.

You may not copy, modify, resell, distribute, publicly display, or create derivative works from the Services or our content without permission.

15. Feedback

If you give us feedback, ideas, suggestions, bug reports, or product requests, we may use them without restriction or compensation to you.

16. Suspension or Termination

We may suspend or terminate your access if you violate these Terms, misuse the Services, create risk for us or others, or if required by law.

You may stop using the Services at any time.

17. Disclaimers

The Services are provided "as is" and "as available."

To the fullest extent permitted by law, Lughara disclaims all warranties, including warranties of accuracy, availability, merchantability, fitness for a particular purpose, non-infringement, and uninterrupted operation.

We do not guarantee that AI feedback, pronunciation checks, transcripts, translations, explanations, or recommendations will be accurate, complete, natural, or suitable for your needs.

18. Limitation of Liability

To the fullest extent permitted by law, Lughara will not be liable for indirect, incidental, special, consequential, punitive, or enhanced damages, or for loss of profits, data, goodwill, use, business opportunity, or learning outcomes.

To the fullest extent permitted by law, Lughara's total liability for any claim related to the Services will not exceed the greater of:

1. the amount you paid to Lughara in the 12 months before the claim arose; or
2. $100.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

19. Indemnity

You agree to defend and hold harmless Lughara, its operators, owners, employees, contractors, tutors, teachers, service providers, and partners from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of the Services, violation of these Terms, violation of law, or submission of content you do not have permission to use.

20. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules.

Unless applicable law requires otherwise, disputes related to these Terms or the Services will be brought in state or federal courts located in Massachusetts.

21. Changes

We may update these Terms from time to time. When we do, we will update the "Last updated" date. Continued use of the Services means you accept the updated Terms.
